Reasons/basis
This notification relates to a Decision to bring Disciplinary Proceedings before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that:-
- In the period from mid 2022 to January 2024, he failed to ensure that any or all of the clients in the Client A (and others) and Client D (and others) appeals to the Court of Appeal were appraised regarding the adverse costs risks of their appeals such that each could make fully informed decisions as to the risks/benefits of the same;
- From 12 July 2022 to October 2023, he failed to report to the SRA that there were (a) indicators of serious financial difficulty relating to the Firm, and/or (b) significant ongoing prejudice and/or risk of prejudice to its clients;
- From November 2021 to around March 2023, he encouraged, allowed and/or directed the issue of Cavity Wall Insulation claims with a value stated as being up to £10,000, notwithstanding that (i) he was aware, or ought to have been aware, that this was misleading, since neither he nor the Firm knew what the value of the claim was, and/or (ii) he ought to have been aware it would be necessary for an employee of the Firm to sign a statement of truth which would in the premises be misleading.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

Jeremy Brooke’s practising certificate for 2023/2024 is subject to the following conditions:
- Jeremy Brooke is not to be a compliance officer for legal practice (COLP) or compliance officer for finance and administration (COFA) for any authorised body.
- Jeremy Brooke is not to be a manager or owner of an authorised body.
- Jeremy Brooke shall not carry on legal activities or supervise others carrying on legal activities in connection with the provision of litigation or any claims work involving conditional fee agreements or damage based agreements.

Reasons/basis
The above interim conditions are made under rule 3.2 of the SRA Regulatory and Disciplinary Procedure Rules, which states that at any stage an authorised decision maker may, pending a final decision by the SRA or the Solicitors Disciplinary Tribunal, impose interim conditions on the practising certificate of a solicitor. We are satisfied that these conditions are necessary in the public interest or for the protection of the public.
